This policy describes JMB Insurance Agency, Inc.’s (“JMB Insurance,” “our” or “we”) privacy practices with regard to personal information you provide JMB Insurance, including when you visit our website at https://www.jmbinsurance.com/ and any related sites operated by JMB Insurance that post a link to this privacy policy (“Sites”), or that JMB Insurance may collect from other sources.
WHAT KIND OF NON-PUBLIC PERSONAL OR PROPRIETARY FINANCIAL INFORMATION DO WE COLLECT AND FROM WHOM
We obtain most information directly through personal contact with you or your authorized agent, or through other sources we consult as we deem applicable to the situation. This may include review of your or your employer’s website or other internet-based sources. We may also collect non-public personal financial information from other sources such as but not limited to: government agencies; consumer reporting agencies; research or analytical companies; marketing or media companies and social media platforms; medical providers; employers; and courts and other government or private records. The types of such information we gather depends on the nature of the insurance involved and/or services we provide. Depending on your relationship with us and the services you are requesting or using, we may collect the following types of personal information:
- Personal identifiers, such as a real name, alias, postal address, unique personal identifier, IP address, e-mail address, account name, social security number, tax identification number, driver’s license number, passport number, and/or other similar identifiers;
- Any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to: name, signature, social security number, physical characteristics and/or description, address, telephone number, social media identifiers and user names; passport number, driver’s license and/or state identification card number; insurance policy number; education, employment, and/or employment history information; bank account number, credit card number, debit card number, and/or any other financial information; medical information (including family medical information) and/or health insurance information, not including publicly available information that is lawfully made available to the general public from federal, state, or local government records.
- Characteristics of protected classifications under state or federal law including, but not limited to, race, religion, sexual orientation, gender identity, gender expression, age and birthdate, birthplace, citizenship, genetic information, veteran or military status, physical or mental disabilities, medical conditions, marital status and/or ancestry;
- Commercial information, including records of personal property, products or services purchased, obtained, or considered, and/or other purchasing or consuming histories or tendencies;
- Internet and/or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding interaction with an internet web site, application, or advertisement;
- Geolocation data;
- Information you voluntarily submit to us by completing any form or survey on the Sites (including in relation to any requests for downloads from our Sites, marketing material, or job information).
- Lifestyle matters such as hobbies and habits;
- Tax obligations;
- Investment preferences; and
- Inferences drawing from any of the information above to create a profile.
Correspondence through electronic media (such as e-mail or through our Sites) may generate additional information that is non-public. Except as set forth herein, we do not collect personal information through our Sites unless you willingly provide it to us, either directly by e-mail or in those areas of the website that request information. You should be reminded that e-mail may not necessarily be secure against interception. Therefore, we suggest you consider this before sending us personal information, especially sensitive personal information, via e-mail.
We may collect certain information about your use of the Sites through the use of tracking technologies and/or by other passive means. We may use Google® Analytics or other analytical service providers to help us collect and analyze this information. This “passively collected” information includes, but is not limited to, the domain name of the website that allowed you to navigate to the Sites, search engines used, the internet protocol (IP) address used, the length of time spent on the Sites, the pages you looked at on the Sites, other websites you visited before and after visiting or accessing the Sites, the type of internet browser you have, the frequency of your visits to the Sites, and other relevant statistics, including the following:
- Log Information. When you access the Sites, our servers automatically record information that your browser sends whenever you visit the Sites. These server logs may include information such as your web request, IP address, MAC address, computer type (e.g., Windows or Macintosh), operating system version, browser type and version, browser language, the date and time of your request, and one or more cookies (small text files containing a string of characters) that may uniquely identify your browser. We use this information to calculate the Sites’ usage levels, to diagnose server problems, to administer the Sites, and to improve the quality of the Sites.
- Links. The Sites may include links in a format that enables us to keep track of whether these links have been followed by IP addresses. We use this information to improve the quality of the Sites’ design.
- Cookies. When you visit or access the Sites, we send one or more cookies (small text files containing a string of characters that asks permission to be placed on your computer’s hard drive) to your computer that uniquely identify your browser. We use cookies to improve the quality of the Sites by storing user preferences and tracking user trends. We only use this information for statistical analysis purposes. Cookies also help us better serve you with more tailored information and facilitate your ongoing access to and use of the Sites. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. Most web browsers accept cookies automatically but can be configured not to do so or to notify the user when a cookie is being sent. If you wish to disable cookies, refer to your browser help menu to learn how to disable cookies. Please note that if you disable cookies, you may not be able to use some customized features on the Sites.
- Web Beacons. Web beacons (also known as “pixel tags” or “clear “GIFs”) are 1×1 single-pixel graphics that allow us to count the number of users who have visited or accessed the Sites and to recognize users by accessing our cookies. We may employ web beacons to facilitate Sites administration and navigation, to track the actions of users of the Sites, to compile aggregate statistics about Sites usage and response rates, and to provide an enhanced online experience for visitors to the Sites. We may also include web beacons in HTML-formatted e-mail messages that we send to determine which e-mail messages were opened.
HOW INFORMATION IS USED
We do not disclose any non-public personal financial information to anyone, except as we may deem necessary to service our clients or comply with applicable law as well as insurance and securities industry regulations. For example, we may disclose non-public personal information in connection with our survey of insurance markets and the filing of coverage applications with various insurance carriers, general agents, registered brokers through whom we or our producers market regulated products under SEC and FINRA rules, such as variable annuities, or other industry sources. Such disclosures may be made to affiliated or non-affiliated persons or entities involved in the underwriting, processing, servicing and marketing of insurance products and adjusting and administration of claims and may include disclosures to companies that perform services on our behalf. We will not disclose any information if such disclosure would be contrary to applicable law.
Depending on our relationship with you, we may use the personal information for the purposes disclosed at the time of collection and/or for one or more of the purposes set forth below.
Personal information may be disclosed to trusted persons working together with us if they are involved in the completion, delivery, or customer support of your order of services offered through the Sites or otherwise by us including, but not limited to, insurance carriers who provide the insurance products.
We may disclose such information to third parties to market their products or services to you if you have consented to these disclosures.
We may disclose or use information in connection with any audits, research, and analysis to maintain, protect, and improve our service offerings, to enhance the Sites, and/or to identify usage trends.
We may use information to create a profile based on the information you provided.
We also may share aggregated anonymous information about visitors to the Sites with third parties so that they can understand the kinds of visitors to the Sites and how those visitors use the Sites. We also provide aggregated anonymous information involving demographics and/or information related to the insurance obtained.
Personal information may also be used: to contact you about any Sites’ updates, and informational and service-related communications, including important security updates; to provide you additional communications, information, and promotions such as newsletters; to inform you of other products or services available from us or our affiliates; and to provide the services requested by you or to fulfill the purpose for which you provide it.
We may disclose your personal information to our subsidiaries and affiliates, and service providers, so we can provide you information about our products and services, as well as perform various business functions, such as data analytics, marketing and advertising, market research, mailings, recruiting and hiring, fraud prevention, and other IT and administrative support functions. We do not authorize our service providers to use or disclose the information except as necessary to perform services or functions on our behalf, or to comply with legal requirements.
We also may share personal information with third parties: (1) if we are required to do so by law or legal process (such as a court order or subpoena); (2) in response to requests by government agencies, such as law enforcement authorities; (3) to meet internal and/or regulatory compliance; (4) to establish, exercise or defend our legal rights; (5) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (6) in connection with an investigation of suspected or actual illegal activity; or (7) in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation).
HOW WE SAFEGUARD NON-PUBLIC PERSONAL INFORMATION IN OUR RECORDS
Except as set forth herein, access to non-public personal information is limited to those persons and entities who need to know the information in order to properly underwrite, process, service and/or market insurance products or services, and/or to file, adjust and administer claims that may be made by or against our clients, and/or to otherwise properly service accounts. We will keep information in our possession physically and electronically secure. If we discover that certain non-public personal information we possess may be inaccurate or false, we will make a reasonable attempt to re-verify and correct the information.
While we do not sell or otherwise disclose client lists or other client information in the ordinary course of business other than as explained herein, we reserve our right to disclose information in certain circumstances including for those set forth herein.
If in the future we determine to share information with affiliates or third parties (including, but not limited to, financial services companies) in order that they may market additional products or services, we will first provide clients with the opportunity to “opt out” in which case their information will not be shared. This does not apply to insurance industry sources that receive such information in connection with our services, as described herein.
HOW LONG WE RETAIN YOUR PERSONAL DATA
Typically, we keep personal information for the length of any contractual relationship and, to the extent permitted by applicable laws, after the end of that relationship for as long as necessary to perform purposes set out in this Privacy Policy, to comply with our legal obligations, to protect JMB Insurance from legal claims and administer our business. When we no longer need to use personal information, we will delete it from our systems and records or take steps to anonymize the data unless we need to keep it longer to comply with a legal or regulatory obligation.
SECURITY
You are responsible for ensuring that your log-in credentials (your username and password) are kept confidential. JMB Insurance has implemented technical and organizational measures designed to secure personal information from accidental loss and from unauthorized access, use, alteration, or disclosure. Notwithstanding such measures, the Internet is an open system, and we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use personal information for improper purposes. Please consider this prior to submitting personal information to us via the Sites.
JMB Insurance utilizes portals or data rooms to help provide security for the uploading and sharing of documents containing personal information in connection with the provision of services. While Microsoft® Sharepoint® is a preferred provider of such portals or data rooms, other providers may be utilized if desired by you or for other reasons. You should review the respective privacy policies and terms of use of any such provider before using them to understand how they handle your personal information. You are responsible for ensuring that your log-in credentials (your username and password) are kept confidential for any such portal or data room.
OPTING OUT
JMB Insurance provides users with the opportunity to opt-out of or discontinue receiving communications from JMB Insurance that are unrelated to your transactions. If you do not desire to continue receiving such communications from JMB Insurance, please follow the opt-out or unsubscribe link and/or instructions included in the e-mail correspondence or send your request to opt out of JMB Insurance at privacy@jmbins.com. It may be necessary to contact affiliates, business partners or other third parties directly in order to cease receiving communications from those third parties.
Please note that these opt-out or unsubscribe options do not apply to communications relating to the administration of services, contracts, support, or other administrative and transactional notices, where the primary purpose of these communications is not promotional in nature.
THIRD PARTY INTERACTION
As a user of the Sites, you may interact with, purchase goods and/or services, or participate in promotions of advertisers, members, partners, or sponsors showing their goods and/or services on the Sites. Unless otherwise stated, any such interaction, purchase or promotion, including the delivery of and the payment for goods and/or services, and any other term, condition, warranty or representation associated with such correspondence, purchase or promotion, is solely between you and the applicable third party. You agree that JMB Insurance, its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees have no liability, obligation, or responsibility for any such interaction, purchase, or promotion between you and any such third party.
JMB Insurance does not guarantee that the hyperlinks, pointers, or other linking functions set out on the Sites will be accurate at the time of your access. Third-party websites maintain their own privacy policies, and we do not exercise any control over any of the third-party websites that may be linked to the Sites. Accordingly, we assume no responsibility for the content of any sites referenced to or by any hyperlink or otherwise, or the sites handling or misuse of your personal information. If you visit a website that is linked to the Sites, you should consult that website’s privacy policy before providing any personal information.
We believe that making hyperlinks available to publicly accessible web pages and news groups is legally permissible and consistent with the common, customary expectations of those who make use of the Internet. You may not provide hyperlinks to the Sites without the prior written consent of JMB Insurance.
EMBEDDED CONTENT FROM OTHER WEBSITES
Articles on the Sites may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.
These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. You should review those websites’ privacy policies to determine how they handle your personal information.
CHANGES/MODIFICATIONS
You may have access to review, correct, update, restrict the use of, change or delete your account profile information or other personal information with JMB Insurance at any time (except you cannot change your username). Such steps may be done by logging into the Sites or customer portal and following the instructions therein, if available, or by contacting JMB Insurance at privacy@jmbins.com. You also may obtain, upon request, the personal information you provided to us in a structured, commonly-used and machine-readable format. Before providing you with a copy of your personal information or correcting, updating, or deleting such information, we reserve the right to verify and authenticate your identity and the personal information to which you have requested access.
Please note that in accordance with our routine corporate record keeping practices, we may delete certain records that contain your personal information. Particularly, any personal information that is no longer needed for the purposes specified herein will be deleted.
If you delete or close your account or account profile information with JMB Insurance altogether, JMB Insurance may retain an archival copy which is not accessible by you or third parties on the Internet. The archival copy is retained only for as long as JMB Insurance reasonably considers necessary for audit and record purposes, or to comply with legal or regulatory obligations. We will retain logs, demographic, indirect, and statistical information about you and keep an archival copy of this information in an anonymous form. We will also retain aggregate anonymized information.
A SPECIAL NOTE ABOUT CHILDREN
The Sites are neither designed for nor intended to attract children under the age of 18, and we do not collect personal information from any individual who we actually know is under the age of 18. We ask that children under the age of 18 not submit any personal information to us. Personal Information on children under 16 will only be knowingly collected with the consent of their parent or guardian.
YOUR CALIFORNIA AND OTHER STATE RIGHTS
Many of the state requirements relating to the collection and use of personal information, if applicable, are otherwise set forth herein. Please note that this privacy policy does not apply when your personal information is protected under other laws such as, but not limited to, the Gramm-Leach Bliley Act. Certain states including California require additional or different disclosures to residents.
We do not share personal information with third parties for their direct marketing purposes unless you affirmatively agree to, or opt in to, such disclosure. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.
GRAMM-LEACH BLILEY ACT
Public Law 106-102 (1999), commonly known as the Gramm-Leach-Bliley Act. Title V of this Act limits certain disclosures of nonpublic personal information by financial institutions, including insurance brokers like JMB Insurance. This privacy policy is intended to provide an overview of our clients’ rights (including former clients) relating to how we collect and use personal information that is disclosed to us. It should be noted that this Act only pertains to certain personal information and does not cover business information.
In order to properly serve our clients, we routinely collect certain non-public information. This is used to assist us in determining the proper products for our clients, assemble underwriting information for the carriers whom we contact to obtain quotes and place coverage, and provide services. Although we generally are not directly involved with the administration of claims on life, accident, or health insurance products, we may from time to time participate in the administration of certain claims where non-public personal information may become relevant. To comply with this Act, when we anticipate that personal medical or health information may be disclosed to us, we will request the execution of a disclosure authorization relating to the federal Health Insurance Portability and Accountability Act. JMB Insurance employees with access to non-public personal information are required to comply with this policy.
We don’t share your financial information with others for non-exempt purposes. In the event that we do so, you have the right under the law to opt out or limit our sharing of your information for non-exempt purposes with our affiliates and other entities at the contact information herein.
UPDATES TO THIS PRIVACY POLICY
We may change or update the Sites or any of our policies and procedures without prior notice. We will post a notice on this Sites to advise you of any significant changes to this Privacy Policy and indicate at the top of this statement when it was most recently updated. Your continued use of the Sites signifies your continued assent to the terms of this Privacy Policy, as updated or amended at that time.
